Chacho's Cafe grants you a limited license to access this website and make personal use of it. This license does not include any resale or commercial use of this site or its contents: any collection and use of any product listings, descriptions, or prices. Any use in data mining, robots or data collection tools and similar extraction tools. You may not reproduce, duplicate, sell, resell, visit or exploit in any other way this website or any part of it for any commercial purpose without receiving express written consent to this from Coffee Chacho's Cafe . Consumer Protection Law
Applicability of the Law and General Declaration
The Company operates in accordance with the provisions of the Consumer Protection Law, 5741–1981 (hereinafter: the “Law”) and the regulations promulgated thereunder.
Without derogating from the foregoing, it is clarified that consumer rights shall apply solely where the statutory conditions defining a “Consumer” and a “Distance Selling Transaction” are fulfilled. The Company reserves the right to assert that a transaction does not fall within the scope of the Law where permitted by applicable law.
1. Disclosure and Reliance
The Company shall provide the Consumer, prior to engagement, with all material details required by law.
The Customer declares that:

He/She reviewed the transaction details prior to approval;

He/She understood the terms of engagement;

He/She did not rely on any representations not expressly stated on the website.
The Customer shall have no claim regarding non-disclosure, except in the event of an explicit breach of a mandatory statutory obligation under the Law.
2. Transaction Confirmation
A purchase made through the website constitutes a Distance Selling Transaction as defined by law.
Confirmation of the transaction shall be sent by electronic means.
The Company’s computerized system records shall constitute prima facie evidence of the execution of the transaction, its date, and its terms.
3. Right of Cancellation – Terms and Limitations
3.1 Applicability
The right of cancellation shall apply solely in cases where all statutory conditions prescribed by the Law and its regulations are fulfilled.
The burden of proof regarding eligibility for cancellation rests with the Customer.
3.2 Cancellation of a Transaction – Goods
Cancellation shall be permitted within 14 days from the date prescribed by law, provided that all of the following cumulative conditions are met:

The product has not been used;

The product is returned in its entirety;
-
The original packaging has not been damaged;
-
No damage, defect, or depreciation in value has occurred.
The Company reserves the right to inspect the product as a condition for issuing a refund.
3.3 Cancellation of a Transaction – Services
Cancellation of services shall be permitted in accordance with the timeframes prescribed by law, provided that the notice of cancellation is delivered in writing and within the statutory period.
If performance of the service has commenced, the Company shall be entitled to proportional payment for the portion already performed, in accordance with applicable law.
3.4 Exceptions
The right of cancellation shall not apply in cases prescribed by law, including, inter alia:

Perishable goods (including fresh food);

Products manufactured specifically for the Customer;
-
Products that have been used;
-
Products whose packaging has been damaged;
-
Products that cannot be returned for reasons of health or hygiene.
3.5 Cancellation Fees
In the event of lawful cancellation, the Company may charge cancellation fees at the maximum rate permitted by law (5% of the transaction price or NIS 100, whichever is lower).
4. Refunds
Refunds shall be made solely through the original method of payment and within the timeframe prescribed by law.
A refund shall be issued only after receipt and inspection of the returned product.
The Company shall not be liable for clearing fees, currency conversion fees, bank charges, or exchange rate differences.
5. Defect or Non-Conformity
In the event of a claim regarding a defect or non-conformity:

The Customer must notify the Company immediately upon discovery;
-
The Company reserves the right to examine the claim prior to making a determination;
-
Remedies shall be provided strictly in accordance with applicable law.
No claim shall be accepted where the defect results from unreasonable use, improper storage, or natural wear and tear.
6. Reservation of Rights and Limitation of Liability
Nothing in this section shall derogate from any mandatory statutory rights of a Consumer.
Except for mandatory statutory obligations under the Law, the Company shall not be liable for indirect, consequential, special damages, or loss of profits.
